Terms of Service (E-commerce Rules) – https://hydroshop.lt e-shop.
These E-commerce Rules (hereinafter referred to as the Rules) are a mandatory and integral part of the purchase and sale agreement concluded between the e-shop https://hydroshop.lt (hereinafter referred to as the “E-shop”) and the person – the customer (hereinafter referred to as the Customer), which acquaints the Customer with the terms and conditions of purchase and sale of e-shop goods and establishes the rights and obligations of the e-shop and the Customer related to the purchase and sale of goods in the E-shop.

I. GENERAL PROVISIONS


1. To use the services of the e-shop has the right to:

1.1. veiksnūs fiziniai asmenys, ne jaunesni kaip 18 metų amžiaus;

1.2. nepilnamečiai nuo šešiolikos iki aštuoniolikos metų amžiaus tik turėdami tėvų, įtėvių arba rūpintojų sutikimą, išskyrus tuos atvejus, kai savarankiškai disponuojama savo uždarbiu ar stipendija;

1.3. juridiniai asmenys;

1.4. visų aukščiau nurodytų asmenų įgalioti atstovai.

2. If the Customer wishes to use the services of the e-shop and complete the order, he must register. Registration is considered to have taken place and is valid when the Client electronically submits information about himself/herself and proceeds to further actions.

3. Personal data provided by the customer (name, surname, address, telephone, e-mail address) when registering in the e-shop shall be stored and processed in accordance with the Law on Legal Protection of Personal Data of the Republic of Lithuania of 11 June 1996 (current version) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data) protection regulation) and this e-shop https://hydroshop.lt described in the “Privacy Policy“.

4. The prices of the goods indicated in the E-shop product catalog are valid only when purchasing these goods in the e-shop. The prices of goods in the e-shop are indicated after including all taxes applicable in accordance with the Law on Tax Administration of the Republic of Lithuania and other legal acts. Delivery prices are not included and are indicated separately when forming an order. The delivery price is clearly indicated to the Customer before the order confirmation and is distinguished in the order confirmation itself.

5. The purchase and sale agreement between the Customer and the e-shop is considered concluded from the moment when the Customer in the e-shop, having formed a basket of goods, indicated the delivery address, selected the payment method and got acquainted (after reading it notes that “I have read and agree with the terms and conditions of the page”) with these Rules, click on the “Pay” button. The agreement concluded electronically between the E-shop and the Customer is regulated in accordance with the procedure established by the Civil Code of the Republic of Lithuania.

6. The E-shop informs the Customer about the conclusion of the purchase and sale agreement by sending a notification to the e-mail address specified by the Customer.

II. RIGHTS AND OBLIGATIONS OF THE CLIENT


7. The Customer can choose and order any product / goods from the goods presented in the catalogs of the e-shop.

8. By using the e-shop services, the Customer agrees with these rules of the purchase and sale agreement and must comply with them.

9. The customer must provide complete and correct data in the e-shop registration form. If the Customer’s personal data has changed and the e-shop is not informed about it, the Customer assumes all the resulting risk of losses.

10. The Customer is responsible for all his actions performed using the E-shop.

11. The same person is prohibited from registering and using the services provided by the e-shop in several names.

12. The customer must be at the specified place, at the specified time and accept the ordered goods.

13. The Client undertakes not to transfer his registration and login data to third parties. If the Customer loses his login data, he must immediately inform the E-shop by e-mail info@dydroshop.lt or in writing, at Vėos str. 12, Vijoliai, Šiauliai district. LT-76224, or by phone +370 630 32461. The e-shop is not responsible for the actions of third parties after using the Customer’s login data until the moment of notification. In this case, the e-shop and has the right to consider that the actions in the E-shop were performed by the Customer.

14. The e-shop shall not be liable for the actions of third parties when, after using the Customer’s banking system, they conclude purchase and sale agreements using the services of the e-shop.

15. In order to be able to offer the Client full-fledged services on our website, please allow the recording of information (cookies) on the Client’s computer (device). “cookies”). The recorded information will be used to recognize the Customer as a previous user of the site, to collect statistics on website traffic. The customer can review at any time what information (cookies) we record and can delete some or all of the saved cookies. Also, has the right to object to the storage and use of information (cookies) on the Client’s computer (device), but in this case, some features of the website may not be available to the Client. Your consent can be canceled at any time by changing the settings of your web browser or by contacting the E-shop with any contacts posted on the website.

III. RIGHTS AND OBLIGATIONS OF THE E-SHOP


16. If during the registration or later false, inaccurate, misleading or not all the requested data is provided, or the Customer fails to comply with other obligations provided for in these Rules, the e-shop has the right to immediately cancel the registration and delete the Customer’s data or restrict the customer’s right to use the services provided by the E-shop. The consequences caused by incorrect data provided by the Customer are the sole responsibility of the Customer.

17. The e-shop reserves the right to:

17.1 Without prior notice, suspend or terminate the customer’s registration and use of the E-shop services if there is reason to believe that the Customer is engaged in unauthorized activities or otherwise tries to harm the operation or stable operation of the e-shop;

17.2 In the event of significant circumstances, temporarily or permanently terminate the activities of the E-shop without prior notice to the Customer.

18. The e-shop undertakes to create all conditions for the Customer to use the services provided by the e-shop.

19. In case of unforeseen circumstances, the e-shop, unable to deliver the ordered product to the Customer, undertakes to offer a similar product to the Customer. If the Customer refuses to accept an analogue of the product, the money paid is refunded within 3 (three) business days, if the Customer has made a prepayment.

IV. PAYMENT FOR THE GOODS


20. The Customer may pay for the goods:

20.1. naudojant banko internetinės bankininkystės sistemas;
20.2. kredito ir debeto kortele;
20.3. išankstiniu bankiniu pavedimu.

V. DELIVERY OF GOODS


21. The e-shop undertakes to deliver the goods ordered by the Customer after payment to the address indicated in the customer’s order in the territory of Lithuania and other EU countries:

21.1. Apmokant pagal Taisyklių 20.1, 20.2, 20.3 punktus, Lietuvoje prekės pristatomos per 1-3 (vieną – tris), darbo dienas nuo patvirtinimo iš banko gavimo. Kitose ES šalyse prekės pristatomos per 5-14 (penkias – keturiolika), darbo dienų nuo patvirtinimo iš banko gavimo.

22. The goods will be delivered by an authorized representative of the e-shop. After the customer signs the consignment note or minus it from the parcel lockers of the authorized representatives, it is considered that the parcel is handed over (delivered) properly.

23. During the delivery of the goods, together with the authorized representative of the e-shop, the Customer must check the condition of the parcel. If the Customer notices a violation of the parcel, he must mark it on the consignment note and draw up a free-form act of violation of the parcel. After the customer signs on the consignment note without notes, it is considered that the parcel has been handed over in order. If the delivered product does not contain any parts or documents, the Customer must immediately inform the E-shop administration by e-mail info@hydroshop.lt or in writing, at Vėos str. 12, Vijoliai, LT-76224 Šiaulių r., or by phone +370 630 32461.

24. Delivery costs the price indicated in the e-shop are not included, they are indicated as provided for in clause 4 of the Rules.

VI. RETURN OF GOODS


25. More than 14 (fourteen) days after the date of delivery of the goods, the Retail Trade Rules of the Republic of Lithuania shall apply to the return of the goods.

26. When a defective product is returned, the E-shop undertakes to accept the defective product and, in the absence of the Customer’s objection, replace it with an analogous product. If the customer objects to the replacement of a defective product with a quality product, we will refund the money paid for the defective product within 3 (three) working days from the date of return of the product. In the event that it turns out that the E-shop does not have an analogous product, the Customer will be refunded the money paid for the product within 3 (three) working days from the moment of this discovery.

27. The returned item must be fully completed. The customer is responsible for the full completion of the product. If the item is not fully completed, it is not accepted for return.

28. In cases where, within 14 (fourteen) days after the delivery of the goods, you notify you of the withdrawal from the purchase and sale agreement (p. 26 of the Rules), it is necessary to submit a completed withdrawal form from the distance purchase and sale agreement or the contract concluded outside the trading premises (free-form application). Refused goods must be returned in the package in which they were delivered. Packaging should be undamaged, clean, properly prepared and packed. In other cases, when returning the goods, the e-shop wishes to comply with the same requirements or to make maximum efforts to comply with the specified requirements for the packaging.

29. The customer has the right to withdraw from the purchase and sale agreement by notifying us about it by e-mail info@hydroshop.lt or in writing, at the address Vėos str. 12, Vijoliai, LT-76224 Šiaulių r., or by phone +370 630 32461, within 14 (fourteen) days from the date of delivery of the goods.

30. In order to withdraw from the purchase and sale agreement, you must notify the withdrawal from the contract in writing (free-form application) to the contact addresses specified in paragraph 29 of the Rules within the period specified in the Rules. A notification about the confirmation of withdrawal from the contract will be received by the e-mail specified by the Client. If the Customer does not receive confirmation within 3 working days, it is mandatory to contact the E-shop administration. After withdrawing from the contract, within 3 (three) working days, the Customer must agree with the E-shop by phone or e-mail the method of returning the goods (all questions of picking up, transporting and other transportation of the goods to the place specified by the e-shop). In this case, the Customer himself must return the purchased product that meets the requirements of clauses 30 and 31 of the Rules. In case of withdrawal from the contract, the money paid for the product will be refunded within 3 (three) working days from the date of return of the goods.

31. The customer does not have the right to withdraw from the purchase and sale agreement if the product has been damaged or the appearance of the product has changed significantly; changes in the appearance of the packaging, which were necessary in order to inspect the received product, are not considered as fundamental changes in the appearance of the product.

VII. FINAL PROVISIONS


32. The e-shop reserves the right to suspend, at its discretion, fill in, change these Rules and other documents related to the Rules. Additions or amendments to the Rules take effect from the date of their publication, i.e. from the day they are placed in the e-shop system.

33. If the Customer does not agree with the new version of the Rules, partial additions, amendments, the Customer has the right to refuse them, provided that the right to use the services of the e-shop is lost.

34. If, after the amendment of the Rules, the Customer continues to use the services provided by the E-shop, it is considered that the new version of the Rules, amendments or additions are accepted.

35. All disagreements regarding the implementation of these Rules shall be resolved by negotiation. In case of failure to reach an agreement within 30 (thirty) days, disagreements shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.

36. An application / complaint regarding the product purchased in the e-shop can be submitted to the State Consumer Rights Protection Authority (http://www.vvtat.lt).

37. These Rules shall be governed by the law of the Republic of Lithuania.
